When a loved one passes, they will often leave assets and debts behind which need to be administered according to law. These assets and debts are referred to as a deceased estate. Administering the deceased estate can be complicated and confusing, however at Willerby's we are here to assist you with the process. By choosing to administer the estate with us, you can relax knowing that we are vastly experienced in this area and will appropriately administer the estate in accordance with the wishes of the testator in the Will.

​​Where there is a Valid Will

In most cases, if the deceased person left behind a valid Will, a Grant of Probate will be required to administer the estate. Receiving the Grant of Probate gives the executor the legal right to administer the estate. However, where the debts and assets left behind are minimal or are jointly owned, a Grant of Probate may not be necessary.

 

Where there is no Valid Will

If the deceased person has not left a Will, or has left a Will that is invalid, Letters of Administration may need to be obtained to authorise an approved person to administer the estate. We can assist with this and advise when necessary.​
